Sean ‘Diddy’ Combs’ next court appearance is scheduled for early October.

Sean ‘Diddy’ Combs’ attorney plans to file an appeal to get him released from prison, according to court documents obtained by ‘People’ on Monday.

After Combs was turned down for bail twice, his attorney, Alexandra Shapiro, announced their intention to file an appeal on Monday. People was informed by a reliable source close to Combs that the formal appeal brief would be filed shortly.

The disgraced music mogul was arrested at a Manhattan hotel on September 16 at 8:25 p.m. The next day, a 14-page indictment was unsealed, revealing the charges against him. His alleged participation in several “freak offs” has been described by prosecutors as “elaborate and produced sex performances.” In addition, he was accused of drugging and assaulting his victims sexually.

Combs is being held at Brooklyn’s Metropolitan Detention Center after being denied bail a second time on September 18.
