A Tokyo court declared that Japan is in a “state of unconstitutionality” because there is no framework in place for same-sex couples to benefit legally from marriage. The court refrained from declaring that it is unconstitutional, though.
Eight plaintiffs in Tokyo, including couples who are of the same sex, filed a lawsuit seeking damages from the state on the grounds that the law’s disapproval of same-sex unions is against the nation’s Constitution, which guarantees legal equality and freedom of marriage.
